Terms of Service

1. Acceptance of Terms

By creating an account, purchasing a plan or initiating any load-testing activity on titanload.io (the “Site”) you agree to be bound by these Terms of Service (“Terms”). If you do not accept the Terms, do not access or use the Services.

 

2. Who We Are

The Site and the load-testing services (collectively, the “Services”) are provided by TECH TITAN ONLINE LTD, company number 15886752, registered office 3rd Floor, 86-90 Paul Street, London EC2A 4NE, United Kingdom (“TitanLoad”, “we”, “us”, “our”).Contact: legal@titanload.io.

 

3. Eligibility and Account Security

You must be at least 18 years old and have authority to bind the business you represent. You are responsible for safeguarding your password and all activity under your account. You must promptly notify us of any unauthorised use.

 

4. Description of Services

TitanLoad provides cloud-based stress- and load-testing of networks, websites, APIs and other Internet-facing assets at bandwidths up to 4.1 Tbps or 34 million requests per second, delivered through fixed-price plans of defined duration.

 

5. Authorised Use Only

You may use the Services solely to test assets that you own or are properly authorised to test. Before each test you must: 

• confirm you control the domain, IP address or system, and 
• obtain any consent required by law, contract or network provider.

 

6. Prohibited Activities

You agree not to:

• launch tests against any third-party or public infrastructure without permission;
• use the Services for denial-of-service, disruption, intrusion, spamming or any unlawful purpose;
• violate export, sanctions or security regulations;
• interfere with, reverse-engineer or exploit the Site;
• resell or lend access to the Services without our written consent.

 

7. Plans, Fees and Payment

Plans are pre-paid at the advertised flat rate via Stripe. All fees are in US dollars, exclusive of any applicable taxes, which are your responsibility. Fees are non-refundable except where required by law.

 

8. Intellectual Property

We retain all rights, title and interest in the Site, the underlying technology and all TitanLoad trademarks. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable licence to use the Services during an active plan.

 

9. Feedback

If you send suggestions or feedback, you grant us a perpetual, royalty-free right to use them without restriction.

 

10. Confidentiality

We will treat any customer data you upload or disclose as confidential and use it only to deliver the Services, except where disclosure is required by law.

 

11. Service Availability and Support

The Services are provided on an “as-is” and “as-available” basis. We endeavour to maintain reasonable uptime but do not guarantee uninterrupted operation. Basic support is available by email; response times are not guaranteed.

 

12. Warranties Disclaimer

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, non-infringement and that the Services will meet your requirements or be error-free.

 

13. Limitation of Liability

To the fullest extent permitted by law, TitanLoad and its officers, employees and suppliers shall not be liable for (a) any indirect, incidental, consequential or punitive damages, or (b) aggregate liability exceeding the higher of US $500 or the amount you paid to TitanLoad for the Services in the twelve months preceding the claim.

 

14. Indemnification

You will defend, indemnify and hold harmless TitanLoad from any claim, loss or expense (including legal fees) arising out of your misuse of the Services, violation of these Terms, or testing of assets you do not own or control.

 

15. Termination

You may cancel your plan at any time; fees remain non-refundable. We may suspend or terminate your access immediately if you breach these Terms or misuse the Services. Sections 8–16 survive termination.

 

16. Changes to Terms

We may modify these Terms with reasonable notice. Continued use after the effective date constitutes acceptance of the revised Terms.

 

17. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any dispute shall be submitted to the exclusive jurisdiction of the courts of England and Wales.

 

18. Severability

If any provision is held unenforceable, the remaining provisions remain in full force.

 

19. Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition or sale of assets.

 

20. Entire Agreement

These Terms, together with our Privacy Policy and any order form or plan details, constitute the entire agreement between you and TitanLoad regarding the Services and supersede all prior agreements.
